The AELTC goes to Court on the Statutory Trust

In our continuing campaign to protect Wimbledon Park, and as promised in our message of 30 September, SWP (Save Wimbledon Park Ltd) has carefully reviewed the GLA's planning decision and identified several errors of law.


As you will see in our recent news item "Save Wimbledon Park Takes Action !", our solicitors recently wrote to the GLA, Merton, Wandsworth and the AELTC about this.


Our first ground concerned the statutory trust, a major protection for all public rights in our urban and suburban green spaces. We have been pointing out for a considerable time that the statutory public recreation trust on which the AELTC hold the heritage golf course land is a fundamental block on the proposed AELTC development, and that the AELTC need to think again.


We are glad to hear that the AELTC now recognise our point of view. We note that they wish to take this to litigation rather than engage in any discussion.


The AELTC may wish this to be seen as a dry, dull, technical irritation which is obstructing the trebling of the size of their commercial entertainment complex. Far from it, this is fundamental to the way in which local authorities all over England hold public trust land. It's been law for 150 years to protect precious green spaces and our environment. Once built upon, it's gone for ever.
